Paternity

Actions for paternity are appropriate when a child is born of a relationship that does not include marriage (often referred to as out of wedlock). When a child is born to unmarried parents, the rights and duties of each parent may be confusing depending on the totality of the circumstances. Filing a paternity action is often a necessary step to establish the legal parentage of a father, as well as custody, visitation, and child support issues.

Modification

There are times when a prior court order may no longer be appropriate for your family as life events change the surrounding circumstances. If you’re finding this to be true in your situation, a “material change of circumstance” is a condition under which you may be able to petition the court to modify its prior order for custody, visitation, or child support based upon the best interests of the child(ren). A modification may be based on the contemptuous behavior of the other party not following the prior court order, on other life events such as remarrying, moving or change of employment, or a combination of several changes over time.

Guardianship

Guardianship is temporary or permanent custody over another individual who is legally incapacitated, either due to being a minor child or an adult incapacitated in another way. To be a guardian in the state of Arkansas, you must: 1) be a resident of Arkansas; 2) be eighteen years of age or older; 3) be of sound mind; and 4) not be a convicted felon or an unpardoned felon.
