Misdemeanors

Misdemeanor charges are brought first in District Court, and if tried in that Court, will be before a judge only without the option for a jury trial. Final verdicts in District Court of misdemeanor charges may be appealed District Court to Circuit Court. At the Circuit Court level, a defendant will have the option for a jury trial.

First Time Offenders

The Arkansas First Offender Act, Ark. Code Ann. §§16-93-301—16-93-303 (Act 346 of 1975), is sometimes an option for someone facing alleged criminal charges for the very first time that may apply to eligible defendants as a way to enter a plea of guilty or no contest and then after a period of probation, if you apply properly, the judge may dismiss and expunge the charges against you.
